1. Introduction
Welcome to drserviceswindsor.com (the “Website”) operated by Derrick Ross Services (the “Company,” “we,” “us,” or “our”). By accessing or using this Website and/or engaging our masonry, restoration and related services (together, the “Services”), you (“you,” “your,” “Client”) agree to be bound by these Terms & Conditions (“Terms”). If you do not agree to these Terms, you must not access the Website or use the Services.

2. Services
2.1 The Company provides masonry restoration, brickwork, stonework, chimney repair, waterproofing & sealing, and related heritage-restoration services as described on the Website. Derrick Ross Services
2.2 All Services are provided subject to these Terms, our quotation, and any project-specific agreement between us and you.
2.3 We will provide a free estimate or consultation upon request. The estimate will include labour, materials, equipment, and cleanup unless otherwise stated. Derrick Ross Services
2.4 If hidden conditions or structural issues are uncovered during the Services (which were not visible or known at the time of estimate), we will notify you and provide options. Such additional work may incur extra charges. Derrick Ross Services

3. Quotations, Payment & Billing
3.1 Our quotations are valid for [30/60] days (or whatever you decide) unless otherwise stated.
3.2 Payment terms are as follows:
 • A deposit of [X%] may be required before work begins.
 • The balance is due upon completion of the Services (or according to the agreed payment schedule).
3.3 Late payments may incur interest at [X%] per month (or the maximum permitted by law).
3.4 In the event of cancellation by you after agreement but before commencement of work, the deposit may be retained as a cancellation fee.
3.5 Materials may be purchased ahead of schedule. If you cancel after materials have been ordered or delivered, you may be liable for those costs.

4. Scheduling & Completion
4.1 We will provide an estimated start date and expected completion date. You accept that these are estimates and subject to change due to weather, hidden defects, access issues, materials availability or other unforeseen circumstances.
4.2 You agree to provide safe access to the work area, utilities (if required), and a safe working environment.
4.3 If you request substantial changes after the work has begun, such changes may require a revision to the quote and schedule.

5. Warranties & Guarantees
5.1 We stand behind the quality of our work. Every project comes with a satisfaction guarantee and a workmanship warranty. Derrick Ross Services
5.2 The warranty covers defects in workmanship for a period of [X months/years] from completion (unless otherwise agreed). It does not cover damage caused by misuse, neglect, modifications by others, Acts of God (including freeze/thaw cycles beyond what was reasonably foreseeable), or normal wear & tear.
5.3 You must provide written notice of any warranty claim within [30] days of discovery of the defect. Upon our verification, we will correct or repair the defect at no additional cost to you.

6. Client Responsibilities
6.1 You must ensure that all necessary permits, approvals and inspections (if applicable) are obtained prior to our work starting, unless otherwise agreed.
6.2 You must clear the work area and remove any personal items or obstacles prior to our arrival.
6.3 You agree to follow our maintenance advice after project completion, such as low-pressure washing instead of high pressure, avoiding harsh chemicals on restored brickwork, as recommended. Derrick Ross Services
6.4 You must allow us access to the work area during normal working hours to perform the Services and any warranty work.

7. Intellectual Property
7.1 The content on the Website (text, images, logos) is owned by the Company or used with permission. You may not reproduce, modify or distribute such content without our prior written consent.
7.2 When we take before/after photos of your project for our marketing, unless otherwise agreed, you grant us a non-exclusive, royalty-free license to use those images in our portfolio, website, social media, promotional materials.

8. Limitation of Liability
8.1 To the maximum extent permitted by law, we exclude all liability for indirect, special or consequential loss (including loss of profits, business interruption, damage to reputation) arising from the Services or use of the Website.
8.2 Our total aggregate liability under or in connection with these Terms, whether in contract, tort (including negligence) or otherwise, is limited to the amount you actually paid us for the specific Services giving rise to the claim.
8.3 Nothing in these Terms excludes or limits liability which cannot be excluded or limited under Ontario law.

9. Termination & Cancellation
9.1 We may terminate our work if you fail to pay any sum when due, or if you materially breach these Terms and fail to remedy the breach within [14] days of notice.
9.2 If we terminate, you remain liable for any work done up to termination plus any materials committed and any reasonable demobilization charges.
9.3 You may cancel or withdraw from the project before work commences; see section 3 for deposit/cancellation fee terms. Once work has commenced, cancellation may trigger full payment for labour/material already provided.

10. Changes to Terms
We may revise these Terms at any time by posting an updated version on the Website. The date at the top of this document will reflect when the Terms were last updated. By continuing to use the Website or our Services after changes, you accept the revised Terms.

11. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Province of Ontario, Canada. Any dispute will be subject to the exclusive jurisdiction of the courts of Windsor/Essex County, Ontario.

12. Severability
If any provision of these Terms is held to be invalid or unenforceable under applicable law, that provision shall be struck out and the remaining provisions shall continue in full force and effect.

13. Entire Agreement
These Terms, together with any quote, project-specific agreement and other documents we reference, constitute the entire agreement between you and us with respect to the Services and supersede all prior agreements or discussions (whether written or oral).
